Bijou Phillips listed the estranged couple's separation date as "undetermined" in their legal documents and said it was "irreconcilable differences" that led to the end of their marriage. She is seeking spousal support, attorney's fees and her legal name changed back to Bijou Phillips. Bijou wants legal and physical custody of her 9-year-old daughter, and she intends to allow Danny visitation. Bijou Phillips has decided to end her marriage to Danny Masterson less than two weeks after he was sentenced to 30 years in prison for rape.
According to legal documents obtained by TMZ, Bijou filed a motion in California state court on Monday to end the matter. Her attorney Peter A. Lauzon told TMZ, "Ms. Phillips has decided to file for divorce from her husband at this unfortunate time. Her priority remains her daughter."
He goes on to say: "This has been an unimaginably difficult time for our marriage and family. Mr. Masterson has always been there for Ms. Phillips during some of the most difficult times in her life. Ms. Phillips admits that Mr. Masterson is a wonderful father to his "daughter."

Bijou stood by Masterson throughout the rape trial and retrial... He was also present during the sentencing.
Danny was found guilty of two counts of rape in May, but her jury hung on the third count. He was first charged in 2020, and the three women said the incidents happened between 2001 and 2003.
Bijou and Danny have a daughter together, born in 2014...and Bijou was reportedly devastated by his conviction. In a letter referenced at the hearing, Bijou called Danny "a partner who saved my life."
As we reported, Ashton Kutcher and Mila Kunis received a lot of heat for writing letters of support for Masterson, commenting on his personality and friendship with the actor. Following backlash, both parties apologized and Ashton resigned from his position at the child sex abuse organization he co-founded.
